Terms and Conditions of Service

These Terms and Conditions ("Terms") govern the relationship between Noah Emshoff Travel Planning LLC ("Planner," "we," "us") and the client ("Client," "you") regarding travel research and itinerary planning services. By paying the service fee, you agree to be bound by these Terms.
1. Scope of Services
Noah Emshoff Travel Planning LLC provides travel research, custom itinerary design, and organizational services. We act as a consultant to help you find travel options; we are not a travel agency.
We do not book travel, process payments for vendors, or act as an intermediary for third-party travel providers.
The final decision and action to book any travel remains solely with the Client.
2. Fees and Non-Refundable Policy
Service Fee: The Client agrees to pay a fee of 5% of the subtotal of all linked flights, hotels, cruises, rental cars, pre-paid transportation plans, and excursions, with a $100 minimum, for the research and planning process. Insurance options and activity suggestions are not included in the 5% charge.
No Refunds: You acknowledge that the service fee is payment for the Planner's time and labor. All fees are 100% non-refundable, regardless of whether you choose to book the travel options presented.
Revisions: The service fee includes the initial itinerary plus one round of minor revisions. Extensive changes or requests for new destinations will require a new service fee.
3. Third-Party Bookings and Payments
Direct Payment: The Client will pay all third-party vendors (airlines, hotels, tour operators, etc.) directly. Noah Emshoff Travel Planning LLC will never ask for, store, or handle your credit card or financial information.
Price Volatility: Quotes and availability provided during research are accurate only at the time of the search. We cannot guarantee that a price or a specific booking will remain available by the time the Client chooses to book.
4. Limitation of Liability & Hold Harmless
Vendor Performance: Noah Emshoff Travel Planning LLC is not responsible for the acts, omissions, or financial stability of third-party vendors. We are not liable for cancellations, delays, strikes, or service failures.
Assumption of Risk: The Client acknowledges that travel involves inherent risks. You agree to hold harmless Noah Emshoff Travel Planning LLC from any claims, damages, or injuries (including financial loss or physical injury) incurred during or as a result of your trip.
Travel Insurance: We strongly recommend that all Clients purchase comprehensive travel insurance to protect against unforeseen circumstances.
5. Client Responsibilities
It is the Client’s sole responsibility to:
Verify that all traveler names match legal identification/passports exactly before booking.
Ensure all passports, visas, and health/vaccination requirements are met for the destination.
Review the terms and cancellation policies of all third-party vendors before making a purchase.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Missouri. Any disputes shall be resolved in the courts of Platte County.
